Just when we thought it was nearly over, Psystar has thrown us all a curve-ball and returned from the dead, emerging from the bankruptcy they filed for. The news, which was reported by The Unofficial Apple Weblog, came in the form of a newsletter to Psystar's previous customers. In the letter (which we have also included below, thanks to TUAW), they stated, "As you may already be aware in late May, Psystar filed for Chapter 11 protection. Although this was critical to our continued daily operations, we now are ready to emerge and again battle Goliath. More information will become available in the coming days when we will be formally discharged by the Bankruptcy court. When life gives you apples, make applesauce."
Coupled with the announcement, they have introduced a new product, dubbed the Open(7). This, as Psystar say, "brings together OS X and Intel Nehalem Xeon technology," which will be the fastest and quietest system yet, according to the company. Pystar plans to include a new boot loader with upcoming systems (the Darwin Universal Boot Loader (DUBL) and TUAW says they're also going to introduce an open source release some time soon.
We don't know how they've done it, but expect to see more legal shenanigans in the near future as they continue on battling 'Goliath'.

How are they leeching. Clearly they are supplying the demand for a product Apple just aren't offering otherwise they wouldn't be able to sell the systems.
Take someone's product, repackage it and sell it as your own.
Do you think people who buy one of these sets off the shelf knows the difference between a genuine Apple product and a grey-area clone such as Psystar?
Is this not how OEM's sell windows so why should it be any different with OSX considering they sell genuine OSX what's the issue ?

This is quite common practice.
It is of course common place with PCs. If not the only method of distribution if you don't build the PC yourself.
There is nothing illegal about it. There is demand. Apple do not feed the demand. Someone else does. Consumer is happy.
And yes I think they very much do. People buying from Psystar are going to be tech'd up somewhat in the first place to know about Psystar. Add to this the fact Apple computers are very iconic and easily noticeable, so say somehow a non-techy came accross Psystar and was interested in purchasing one, even they would know that it is clearly not a product manufactured by Apple.

No, they are trying to free people from the restrictive Apple hardware and bring OSX into the enthusiast arena without them having to contend with the prohibiting cost of buying a mac pro.
